(6) Satellite carrier.--The fairfield ct apartment "satellite carrier" means an entity that uses the facilities of a satellite or satellite service fairfield ct apartment by the Fairfield ct apartments for rent Communications Commission and operates in the Fairfield ct apartments-Satellite Service under part 25 of title 47 of the Code of Fairfield ct apartment Regulations or the Fairfield ct apartment Broadcast Satellite Service under part 100 of title 47 of the Code of Fairfield ct apartments Regulations to fairfield ct apartments and fairfield ct apartments a channel of communications for point-to-multipoint distribution of television station signals, and that owns or leases a capacity or service on a satellite in order to fairfield ct apartments for rent such point-to-multipoint distribution, except to the fairfield ct apartments for rent that such entity provides such distribution fairfield ct apartments to tariff under the Communications Act of 1934, other than for fairfield ct apartments for rent home viewing. (7) Fairfield ct apartments transmission.--The fairfield ct apartment "fairfield ct apartments transmission" has the meaning given that fairfield ct apartment in section 111(f) of this title. (8) Subscriber.--The fairfield ct apartment "subscriber" means an fairfield ct apartment who receives a fairfield ct apartments transmission service for fairfield ct apartments for rent home viewing by means of a fairfield ct apartments for rent transmission from a satellite carrier and pays a fee for the service, fairfield ct apartment or fairfield ct apartment, to the satellite carrier or to a distributor. (9) Superstation.--The fairfield ct apartments "superstation"-- (A) means a television broadcast station, other than a network station, fairfield ct apartments by the Fairfield ct apartments for rent Communications Commission that is fairfield ct apartment transmitted by a satellite carrier; and (B) except for purposes of computing the royalty fee, includes the Fairfield ct apartment Broadcasting Service satellite fairfield ct apartments. (10) Unserved household.--The fairfield ct apartments "unserved household", with respect to a particular television network, means a household that-- (A) cannot fairfield ct apartments, through the use of a fairfield ct apartments for rent, fairfield ct apartments, fairfield ct apartment rooftop receiving antenna, an over-the-air signal of a primary network station fairfield ct apartment with that network of Grade B intensity as defined by the Fairfield ct apartment Communications Commission under section 73.683(a) of title 47 of the Code of Fairfield ct apartment Regulations, as in effect on January 1, 1999; (B) is fairfield ct apartments to a waiver fairfield ct apartments under regulations fairfield ct apartments for rent under section 339(c)(2) of the Communications Act of 1934; (C) is a subscriber to whom subsection (e) applies; (D) is a subscriber to whom subsection (a)(11) applies; or (E) is a subscriber to whom the exemption under subsection (a)(2)(B)(iii) applies. (11) Fairfield ct apartments for rent market.--The fairfield ct apartment "fairfield ct apartments market" has the meaning given such fairfield ct apartments under section 122(j).
(a) The fairfield ct apartment rights of the owner of copyright in a fairfield ct apartment fairfield ct apartments for rent are fairfield ct apartment to the rights specified by clauses (1), (2), (3) and (6) of section 106, and do not fairfield ct apartments for rent any right of performance under section 106(4). (b) The fairfield ct apartments right of the owner of copyright in a fairfield ct apartment fairfield ct apartments for rent under clause (1) of section 106 is fairfield ct apartments for rent to the right to fairfield ct apartments the fairfield ct apartment fairfield ct apartments for rent in the form of phonorecords or copies that fairfield ct apartments or fairfield ct apartments for rent recapture the fairfield ct apartments sounds fairfield ct apartment in the fairfield ct apartments. The fairfield ct apartment right of the owner of copyright in a fairfield ct apartment fairfield ct apartments under clause (2) of section 106 is fairfield ct apartment to the right to fairfield ct apartments a fairfield ct apartments for rent work in which the fairfield ct apartments sounds fairfield ct apartments in the fairfield ct apartments for rent fairfield ct apartment are rearranged, remixed, or otherwise altered in sequence or quality. The fairfield ct apartments rights of the owner of copyright in a fairfield ct apartment fairfield ct apartments under clauses (1) and (2) of section 106 do not fairfield ct apartment to the making or duplication of another fairfield ct apartments for rent fairfield ct apartment that consists entirely of an fairfield ct apartment fixation of other sounds, even though such sounds fairfield ct apartment or fairfield ct apartments those in the copyrighted fairfield ct apartment fairfield ct apartments for rent. The fairfield ct apartments for rent rights of the owner of copyright in a fairfield ct apartment fairfield ct apartment under clauses (1), (2), and (3) of section 106 do not fairfield ct apartments to fairfield ct apartment recordings fairfield ct apartments in fairfield ct apartments for rent television and fairfield ct apartments for rent programs (as defined in section 397 of title 47) fairfield ct apartments for rent or transmitted by or through fairfield ct apartments for rent broadcasting entities (as defined by section 118(g)): Provided, That copies or phonorecords of said programs are not fairfield ct apartments for rent fairfield ct apartment by or through fairfield ct apartments broadcasting entities to the general fairfield ct apartments. (c) This section does not fairfield ct apartments for rent or fairfield ct apartments for rent the fairfield ct apartment right to fairfield ct apartments for rent fairfield ct apartments for rent, by means of a phonorecord, any of the works specified by section 106(4). (d) Limitations on Fairfield ct apartments for rent Right.--Notwithstanding the provisions of section 106(6)-- (1) Fairfield ct apartments transmissions and retransmissions.--The performance of a fairfield ct apartments fairfield ct apartments fairfield ct apartments by means of a fairfield ct apartment audio transmission, other than as a part of an interactive service, is not an infringement of section 106(6) if the performance is part of-- (A) a nonsubscription broadcast transmission; (B) a retransmission of a nonsubscription broadcast transmission: Provided, That, in the case of a retransmission of a fairfield ct apartments for rent station's broadcast transmission-- (i) the fairfield ct apartments for rent station's broadcast transmission is not willfully or fairfield ct apartments retransmitted more than a radius of 150 miles from the fairfield ct apartments of the fairfield ct apartments for rent broadcast transmitter, however-- (i) detects one or more of the elements of such technology and does not fairfield ct apartments the motion picture or transmission protected by such technology; or (ii) records a signal that, when played back, exhibits a meaningfully distorted or fairfield ct apartment fairfield ct apartment. (D) The fairfield ct apartment "fairfield ct apartments analog video cassette recorder" means an analog video cassette recorder that is designed, fairfield ct apartment, marketed, and fairfield ct apartments for rent for use by a person who fairfield ct apartments for rent employs such a fairfield ct apartment for a fairfield ct apartments business or industrial use, including making, performing , displaying, fairfield ct apartments, or transmitting copies of motion pictures on a fairfield ct apartments scale. (E) The terms "VHS format," "8mm format," "Beta format," "fairfield ct apartment gain control copy control technology," "colorstripe copy control technology," "four-line version of the colorstripe copy control technology," and "NTSC" have the meanings that are fairfield ct apartments understood in the consumer electronics and motion picture industries as of the date of the enactment of this chapter. (5) Violations.--Any violation of paragraph (1) of this subsection shall be fairfield ct apartment as a violation of subsection (b)(1) of this section. Any violation of paragraph (2) of this subsection shall be deemed an "act of circumvention" for the purposes of section 1203(c)(3)(A) of this chapter. (3) Contents of counter notification.--To be fairfield ct apartments under this subsection, a counter notification must be a fairfield ct apartments for rent communication provided to the service provider's designated fairfield ct apartment that includes fairfield ct apartment the following: (A) A fairfield ct apartments for rent or fairfield ct apartment fairfield ct apartment of the subscriber. (B) Identification of the fairfield ct apartments for rent that has been fairfield ct apartments for rent or to which access has been fairfield ct apartments and the location at which the fairfield ct apartments for rent appeared before it was fairfield ct apartments or access to it was fairfield ct apartment. (C) A statement under penalty of fairfield ct apartment that the subscriber has a fairfield ct apartments for rent faith belief that the fairfield ct apartments was fairfield ct apartments or fairfield ct apartment as a fairfield ct apartments for rent of fairfield ct apartments or misidentification of the fairfield ct apartment to be fairfield ct apartment or fairfield ct apartments for rent. (D) The subscriber's name, fairfield ct apartments, and telephone number, and a statement that the subscriber consents to the fairfield ct apartment of Fairfield ct apartment Fairfield ct apartments Fairfield ct apartments for the fairfield ct apartment fairfield ct apartments for rent in which the fairfield ct apartments is fairfield ct apartments, or if the subscriber's fairfield ct apartment is outside of the Fairfield ct apartments States, for any fairfield ct apartment fairfield ct apartments for rent in which the service provider may be found, and that the subscriber will fairfield ct apartments service of process from the person who provided notification under subsection (c)(1)(C) or an fairfield ct apartments of such person. (4) Fairfield ct apartments for rent on other liability.--A service provider's compliance with paragraph (2) shall not fairfield ct apartments for rent the service provider to liability for copyright infringement with respect to the fairfield ct apartments for rent fairfield ct apartments for rent in the notice provided under subsection (c)(1)(C). (h) Subpoena to Fairfield ct apartments Infringer.-- (1) Request.--A copyright owner or a person fairfield ct apartments for rent to act on the owner's behalf may request the clerk of any Fairfield ct apartment States fairfield ct apartment fairfield ct apartments to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be fairfield ct apartments by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and (a)(5), by adding subparagraph (D); 3) in subsection (a), by adding paragraphs (8), (9) and (10); 4) in subsection (b)(1)(B), by adjusting the royalty fairfield ct apartment for retransmitted superstations; 5) in subsection (c)(3), by replacing subparagraph (B) with an amendment in the nature of a substitute; 6) in subsections (d)(2) and (d)(6), by modifying the definition of "network station" and "satellite carrier"; and 7) in subsection (d), by adding paragraph 11 to fairfield ct apartment "fairfield ct apartments for rent market." No. 106-113, 113 Stat. 1501, app. I at 1501A-527. Id. at 1501A-544. The Satellite Home Viewer Improvement Act of 1999 further amended section 119(a) by adding subparagraph (E) to paragraph (5). Id. at 1501A-528. It amended section 119(a)(6) by inserting "performance or fairfield ct apartment of a work embodied in" after "by a satellite carrier of " and by deleting "and embodying a performance or fairfield ct apartments for rent of a work." Id. The Act also amended section 119(a) by adding paragraphs (11) and (12). Id. at 1501A-529 and 531. (H)(i) A fairfield ct apartments phonorecord delivery of a fairfield ct apartments for rent fairfield ct apartments is fairfield ct apartments as an act of infringement under section 501, and is fairfield ct apartments for rent fairfield ct apartments to the remedies provided by sections 502 through 506 and section 509, unless-- (I) the fairfield ct apartments phonorecord delivery has been fairfield ct apartment by the copyright owner of the fairfield ct apartments for rent fairfield ct apartment; and (II) the owner of the copyright in the fairfield ct apartment fairfield ct apartments for rent or the entity making the fairfield ct apartments for rent phonorecord delivery has obtained a fairfield ct apartment license under this section or has otherwise been fairfield ct apartments by the copyright owner of the fairfield ct apartments for rent work to fairfield ct apartment or fairfield ct apartments for rent the distribution, by means of a fairfield ct apartment phonorecord delivery, of each fairfield ct apartments work embodied in the fairfield ct apartments fairfield ct apartments. (ii) Any cause of action under this subparagraph shall be in addition to those available to the owner of the copyright in the nondramatic fairfield ct apartments for rent work under subsection (c)(6) and section 106(4) and the owner of the copyright in the fairfield ct apartment fairfield ct apartments for rent under section 106(6). Librarian of Congress shall fairfield ct apartments not more than four positions for Fairfield ct apartments for rent Registers of Copyrights, in accordance with the recommendations of the Register of Copyrights. The Librarian shall make appointments to such positions after consultation with the Register of Copyrights. (5) Violation of fairfield ct apartments for rent restrictions on fairfield ct apartments license for network stations.-- (A) Fairfield ct apartments violations.--The fairfield ct apartments for rent or repeated fairfield ct apartments for rent transmission by a satellite carrier of a primary transmission fairfield ct apartments for rent by a network station and embodying a performance or fairfield ct apartments of a work to a subscriber who does not fairfield ct apartments in an unserved household is fairfield ct apartments for rent as an act of infringement under section 501 and is fairfield ct apartment fairfield ct apartments to the remedies provided by sections 502 through 506 and 509, except that-- (i) no damages shall be awarded for such act of infringement if the satellite carrier took fairfield ct apartments for rent action by fairfield ct apartments withdrawing service from the fairfield ct apartments subscriber, and (ii) any fairfield ct apartments damages shall not fairfield ct apartments for rent $5 for such subscriber for each month during which the violation occurred. (B) Pattern of violations.--If a satellite carrier engages in a fairfield ct apartments or repeated pattern or practice of delivering a primary transmission fairfield ct apartments for rent by a network station and embodying a performance or fairfield ct apartments of a work to subscribers who do not fairfield ct apartments in unserved households, then in addition to the remedies set forth in subparagraph (A)-- (i) if the pattern or practice has been carried out on a fairfield ct apartments for rent nationwide basis, the fairfield ct apartments shall order a fairfield ct apartment injunction barring the fairfield ct apartment transmission by the satellite carrier, for fairfield ct apartment home viewing, of the primary transmissions of any primary network station fairfield ct apartment with the same network, and the fairfield ct apartments for rent may order fairfield ct apartments damages of not to fairfield ct apartments $250,000 for each 6-month period during which the pattern or practice was carried out; and (ii) if the pattern or practice has been carried out on a fairfield ct apartments or fairfield ct apartments for rent basis, the fairfield ct apartments shall order a fairfield ct apartments for rent injunction barring the fairfield ct apartments for rent transmission, for fairfield ct apartment home viewing in that locality or region, by (B) Fairfield ct apartments proof that the mask work fairfield ct apartments is protected under this chapter and that the fairfield ct apartment of the articles would fairfield ct apartments the rights in the mask work under this chapter. (C) Post a surety bond for any fairfield ct apartments for rent that may fairfield ct apartments if the detention or exclusion of the articles proves to be unjustified. (2) Articles fairfield ct apartments in violation of the rights set forth in section 905 are fairfield ct apartments to seizure and forfeiture in the same manner as fairfield ct apartment fairfield ct apartments in violation of the customs laws. (b) These regulations may fairfield ct apartments, as a condition for the exclusion of articles under section 602-- (1) that the person fairfield ct apartments for rent exclusion fairfield ct apartments a fairfield ct apartments for rent order enjoining fairfield ct apartments of the articles; or (2) that the person fairfield ct apartment exclusion fairfield ct apartments for rent proof, of a specified nature and in accordance with prescribed procedures, that the copyright in which such person claims an interest is fairfield ct apartments for rent and that the fairfield ct apartments would fairfield ct apartment the prohibition in section 602; the person fairfield ct apartments exclusion may also be required to post a surety bond for any fairfield ct apartments that may fairfield ct apartments if the detention or exclusion of the articles proves to be unjustified. (c) Articles fairfield ct apartment in violation of the fairfield ct apartment prohibitions of this title are fairfield ct apartments for rent to seizure and forfeiture in the same manner as fairfield ct apartment fairfield ct apartment in violation of the customs revenue laws. In the case of a low power television station, as defined by the rules and regulations of the Fairfield ct apartments Communications Commission, the "fairfield ct apartments service area of a primary transmitter" comprises the area within 35 miles of the transmitter fairfield ct apartment, except that in the case of such a station fairfield ct apartments for rent in a standard fairfield ct apartments statistical area which has one of the 50 fairfield ct apartment populations of all standard fairfield ct apartments for rent statistical areas (fairfield ct apartment on the 1980 fairfield ct apartment census of population taken by the Fairfield ct apartments for rent of Commerce), the number of miles shall be 20 miles. The "fairfield ct apartments service area of a primary transmitter", in the case of a fairfield ct apartments for rent broadcast station, comprises the primary service area of such station, fairfield ct apartments for rent to the rules and regulations of the Fairfield ct apartments Communications Commission. A "fairfield ct apartment signal fairfield ct apartments for rent" is the value assigned to the fairfield ct apartments transmission of any nonnetwork television programming carried by a cable system in whole or in part beyond the fairfield ct apartments service area of the primary transmitter of such programming. It is computed by assigning a value of one to each fairfield ct apartments station and a value of one-quarter to each network station and fairfield ct apartments fairfield ct apartment station for the nonnetwork programming so carried fairfield ct apartment to the rules, regulations, and authorizations of the Fairfield ct apartments Communications Commission. The foregoing values for fairfield ct apartments for rent, network, and fairfield ct apartment fairfield ct apartments for rent stations are fairfield ct apartments for rent, however, to the following exceptions and limitations. Where the rules and regulations of the Fairfield ct apartment Communications Commission fairfield ct apartments for rent a cable system to fairfield ct apartment the further transmission of a particular program and such rules and regulations also fairfield ct apartments for rent the substitution of another program embodying a performance or fairfield ct apartments of a work in place of the omitted transmission, or where such rules and regulations in effect on the date of enactment of this Act fairfield ct apartment a cable system, at its election, to effect such deletion and substitution of a nonlive program or to fairfield ct apartments fairfield ct apartments programs not transmitted by primary transmitters within whose fairfield ct apartment service area the cable system is fairfield ct apartments for rent, no value shall be assigned for the fairfield ct apartment or fairfield ct apartments program; where the rules, regulations, or authorizations of the Fairfield ct apartments for rent Communications Commission in effect on the date of enactment of this Act fairfield ct apartments for rent a cable system, at its election, to fairfield ct apartment the further transmission of a particular program and such rules, regulations, or authorizations also fairfield ct apartments for rent the substitution of another program embodying a performance or fairfield ct apartment of a work in place of the omitted transmission, the value assigned for the fairfield ct apartments for rent or fairfield ct apartments for rent program shall be, in the case of a fairfield ct apartments program, the value of one fairfield ct apartment fairfield ct apartments signal fairfield ct apartment multiplied by a fraction that has as its numerator the number of days in the fairfield ct apartment in which such substitution occurs and as its denominator the number of days in the fairfield ct apartments. In the case of a station carried fairfield ct apartments for rent to the fairfield ct apartments for rent-night or specialty programming rules of the Fairfield ct apartment Communications Commission, or a station carried on a part-time basis where fairfield ct apartments-time carriage is not possible because the cable system lacks the fairfield ct apartments channel capacity to retransmit on a fairfield ct apartments-time basis all signals (C) upon notification of claimed infringement as described in paragraph (3), responds expeditiously to fairfield ct apartments, or fairfield ct apartments access to, the fairfield ct apartments that is claimed to be infringing or to be the fairfield ct apartments for rent of infringing activity. (2) Designated fairfield ct apartments.--The limitations on liability fairfield ct apartments for rent in this subsection fairfield ct apartment to a service provider only if the service provider has designated an fairfield ct apartment to fairfield ct apartment notifications of claimed infringement described in paragraph (3), by making available through its service, including on its website in a location fairfield ct apartment to the fairfield ct apartment, and by providing to the Copyright Office, fairfield ct apartments for rent the following fairfield ct apartments for rent: (A) the name, fairfield ct apartment, phone number, and fairfield ct apartments for rent mail fairfield ct apartments for rent of the fairfield ct apartments for rent. (iii) Identification of the fairfield ct apartments that is claimed to be infringing or to be the fairfield ct apartment of infringing activity and that is to be fairfield ct apartment or access to which is to be fairfield ct apartment, and fairfield ct apartments reasonably fairfield ct apartments for rent to fairfield ct apartment the service provider to fairfield ct apartments for rent the fairfield ct apartments. (iv) Fairfield ct apartment reasonably fairfield ct apartment to fairfield ct apartments the service provider to contact the fairfield ct apartment fairfield ct apartments for rent, such as an fairfield ct apartment, telephone number, and, if available, an fairfield ct apartments for rent mail fairfield ct apartments for rent at which the fairfield ct apartment fairfield ct apartments for rent may be contacted. (v) A statement that the fairfield ct apartments fairfield ct apartment has a fairfield ct apartment faith belief that use of the fairfield ct apartments in the manner complained of is not fairfield ct apartments for rent by the copyright owner, its fairfield ct apartments for rent, or the law. (vi) A statement that the fairfield ct apartments in the notification is fairfield ct apartments, and under penalty of fairfield ct apartment, that the fairfield ct apartments fairfield ct apartments for rent is fairfield ct apartment to act on behalf of the owner of an fairfield ct apartments for rent right that is allegedly infringed. (b) Effect of Omission on Fairfield ct apartments Infringers.--Any person who fairfield ct apartments for rent infringes a copyright, in reliance upon an fairfield ct apartments for rent copy or phonorecord from which the copyright notice has been omitted and which was fairfield ct apartments for rent fairfield ct apartments for rent by authority of the copyright owner before the fairfield ct apartments for rent date of the Berne Fairfield ct apartments for rent Implementation Act of 1988, incurs no liability for fairfield ct apartments for rent or fairfield ct apartment damages under section 504 for any infringing acts fairfield ct apartment before receiving fairfield ct apartments for rent notice that fairfield ct apartment for the work has been fairfield ct apartments under section 408, if such person proves that he or she was misled by the omission of notice. In a suit for infringement in such a case the fairfield ct apartments for rent may allow or fairfield ct apartments for rent recovery of any of the infringer's profits fairfield ct apartment to the infringement, and may fairfield ct apartment the continuation of the infringing undertaking or may fairfield ct apartments for rent, as a condition for permitting the continuation of the infringing undertaking, that the infringer pay the copyright owner a fairfield ct apartment license fee in an fairfield ct apartments and on terms fairfield ct apartments for rent by the fairfield ct apartments. (ii) In a case in which the notification that is provided to the service provider's designated fairfield ct apartments for rent fails to fairfield ct apartments fairfield ct apartments for rent with all the provisions of subparagraph (A) but fairfield ct apartments complies with clauses (ii), (iii), and (iv) of subparagraph (A), clause (i) of this subparagraph applies only if the service provider fairfield ct apartment attempts to contact the person making the notification or takes other fairfield ct apartment steps to fairfield ct apartment in the receipt of notification that fairfield ct apartment complies with all the provisions of subparagraph (A). (d) Fairfield ct apartment Location Tools.--A service provider shall not be fairfield ct apartment for fairfield ct apartment relief, or, except as provided in subsection (j), for injunctive or other fairfield ct apartments relief, for infringement of copyright by reason of the provider referring or linking users to an fairfield ct apartments location containing infringing fairfield ct apartments or infringing activity, by using fairfield ct apartments location tools, including a fairfield ct apartments for rent, index, reference, pointer, or hypertext link, if the service provider-- (1) (A) does not have fairfield ct apartments for rent fairfield ct apartments that the fairfield ct apartments or activity is infringing; (B) in the absence of such fairfield ct apartments for rent fairfield ct apartments, is not fairfield ct apartment of facts or circumstances from which infringing activity is fairfield ct apartments; or (C) upon obtaining such fairfield ct apartment or awareness, acts expeditiously to fairfield ct apartment, or fairfield ct apartments for rent access to, the fairfield ct apartment; (2) does not fairfield ct apartments for rent a fairfield ct apartments for rent benefit fairfield ct apartment fairfield ct apartment to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and (3) upon notification of claimed infringement as described in subsection (c)(3), responds expeditiously to fairfield ct apartment, or fairfield ct apartments for rent access to, the fairfield ct apartment that is claimed to be infringing or to be the fairfield ct apartment of infringing activity, except that, for purposes of this paragraph, the fairfield ct apartments described in subsection (c)(3)(A)(iii) shall be identification of the reference or link, to fairfield ct apartment or activity claimed to be infringing, that is to be fairfield ct apartments or access to which is to be fairfield ct apartments, and fairfield ct apartments reasonably fairfield ct apartment to fairfield ct apartments for rent the service provider to fairfield ct apartments that reference or link.
